It may not be appropriate to adopt this Model Ordinance precisely as it is written. It is intended to be advisory, and users should not rely upon it as legal advice. Local government officials are urged to seek legal advice from their attorneys before enacting a utility-scale solar energy system ordinance.

Do new solar panels need a permit?

The new solar PV modules must be part of the ADU’s permit application, sized per the Energy Code, and comply with other parts of the building code as applicable. Does a newly constructed ADU need to comply with requirements in Section 110.10 if the project doesn’t require PV?
